Reuben Foster has one charge dismissed, still facing domestic violence charge

The woman who accused Reuben Foster of domestic violence reversed course and recanted her claim last week, but that does not mean the San Francisco 49ers linebacker is off the hook in the case.

On Monday, a judge dismissed a misdemeanor ammunition charge against Foster for the high-magazine clip that was found in his home by police on Feb. 11. However, he is still facing several other charges and his plea hearing was delayed until May 8 so prosecutors can review a piece of video evidence. As Matt Barrows of the Sacramento Bee notes, the video allegedly shows Foster’s girlfriend fighting with another woman the morning Foster was arrested.

Foster is still facing three felony charges — domestic violence with an allegation that he inflicted great bodily injury, forcefully attempted to prevent a victim from reporting a crime and possession of an assault weapon.

The woman who initially accused Foster said last week that she blamed the former Alabama star for injuries she sustained in a fight with another woman. The original details of the alleged incident painted a very disturbing picture of Foster’s involvement, but his girlfriend has recanted the claims.

Prosecutors have decided to move forward with the case anyway, and they can use the medical report, 911 phone call, and photos as evidence to support their case.
