As far as the testing goes, I can’t believe he was arrested based on those. And Boston is right, you cannot be forced to take a field sobriety test…but they can compel you to take a breathalizer/blood test which Boston volunteered for. At one point doesn’t the officer say ‘you have the right to take a field sobriety test required by law, it’s what your license says’ –where does he get that from? I’ve never heard of such a thing.

IMHO, there’s more damning evidence about the cop screwing up or lying than Boston walking the line, which he did ok, touching his nose which he did ok, stand there for 30+ seconds on one foot in which he wavered slightly(but who wouldn’t even when sober?) and saying the alphabet in that odd manner where it sounded fine except I think he misspoke on the letters U/W. We see these tests on TV all the time and actual drunks have problems with every test.

Whoever Boston hires as an attorney should pick this apart easily. And by the way, never take a field sobriety test.
